This section represents a fundamental area of the Platform and is intended to help you understand how carptackle.eu operates assess its use, and understand your rights and obligations when using the Platform.
You are therefore invited to carefully review these Terms and Conditions together with the specific provisions set out in the Privacy Policy, the Cookie Policy, and the Community Values and Code of Conduct, which govern our activities and regulate the relationship between the Platform and its users.
CarpTackle is committed to ensuring that its community can understand, with clarity and immediacy, the legal conditions governing the operation of the Platform and the relationship between the Platform and its users, within an increasingly complex regulatory framework.
These Terms and Conditions of Use (the “Terms and Conditions”) set out the conditions under which users are granted access to the websites, services, and applications of carptackle.eu (the “Service”).
Use of the Service confers the status of user of the Service (hereinafter, the “User”) and implies full acceptance of these Terms and Conditions.
If the User does not agree with all or any part of these Terms and Conditions, the User must refrain from using the Service and must immediately discontinue any interactive or usage-related activity with and through the Platform.
By accepting these Terms and Conditions, the User declares that:
- the User has read, understood, and fully comprehended the contents of this document;
- the User assumes all obligations, is aware of their rights, and accepts full responsibility arising from the use of the Service as described herein and as provided for by applicable laws and regulations governing the Platform;
- the User is of legal age and has the legal capacity required to use the Service.
- Please read these Terms and Conditions carefully together with the Privacy Policy, the Cookie Policy, and the Community Values and Code of Conduct.
- Acceptance of these Terms and Conditions, the Privacy Policy, the Cookie Policy, and the Community Values and User Code of Conduct is a preliminary and essential requirement for the use of the Service.
- Carp Tackle reserves the right to update and/or amend these Terms and Conditions at any time and for any reason, at its sole discretion. Users are therefore encouraged to regularly review the relevant sections of the Platform in order to remain informed of any updates and/or material changes to the Service.
- By accessing or using the Services after Carp Tackle has implemented any modification or update to the Service, the User acknowledges and accepts the updated Terms and Conditions as amended.
If the amended Terms and Conditions are not acceptable to the User, the User must discontinue use of the Services.
DEFINITIONS
For the purposes of these Terms and Conditions of Use, the following terms shall have the meanings set out below:
- Buyer: a User who purchases products and/or used equipment through the Marketplace.
- “Listing”: a page containing images, text, descriptions, and other information published by a User for the purpose of advertising a Product for sale.
- “Held Funds / escrow-like mechanism”: a monetary amount temporarily held by the Payment Provider until the conditions for delivery of the Product have been fulfilled (for example, validation of shipment tracking). The release of funds takes place in accordance with the procedures defined by the Platform and the Payment Provider.
- Marketplace: the online platform operated by carptackle.eu, which allows Users to publish, sell, and purchase exclusively used products and equipment for carp fishing.
- User: any natural person who accesses or uses the Marketplace.
- Seller: a User who offers products and/or used equipment for sale through the Marketplace.
- Paid Listing Visibility Services: optional tools made available by CarpTackle to increase the visibility of listings, such as listing highlighting or featured placement, where available.
- Payment Provider: a third-party provider appointed to manage payments, transactions between Users, and the handling of funds, such as Stripe or any other available provider.
- “Report Abuse” or “Report”: a function that allows Users to report issues, improper behaviour, or disputes relating to a Listing, a Product, or another User.
2. SCOPE OF THE SERVICE
Carp Tackle acts exclusively as a technical intermediary, facilitating contact between buyers and sellers.
The Platform participates in sales transactions in accordance with the rules and limitations imposed by the payment service provider, which operates as an independent entity outside the Platform. Carp Tackle does not guarantee the quality, compliance, or integrity of the products offered for sale and cannot assume any mediation role between the parties.
Carp Tackle does not modify, alter, or intervene in any way in the content or graphic presentation of listings and/or content published by Users.
All interactions and transactions take place exclusively between private individuals.
Carp Tackle is not a party to the sales contract, does not hold or transfer funds outside the technical procedures managed by the Payment Service Provider, and does not receive any commission, fee, or remuneration from the Payment Service Provider in relation to completed sales, as the remuneration for the Platform’s services derives from successfully completed transactions conducted directly between the users involved in the transaction.
Carp Tackle shall not be held liable for any default, delay, or improper conduct by any User.
Likewise, Carp Tackle shall not, in any way or in whole or in part, be held liable for any actions, conduct, or policies adopted by the Payment Service Provider and/or by couriers, whose terms of use and service conditions are accepted directly by the Users.
3. GENERAL RULES
The User agrees to comply with the following general rules when using the Platform:
- The User shall not introduce, publish, or disseminate content or propaganda that is racist, xenophobic, pornographic, promotes terrorism, armed conflict, hatred, or that violates human rights.
- The User shall not disseminate, transmit, or make available to third parties any information, element, or content that violates fundamental rights and public freedoms recognised by national constitutions or by international and national treaties.
- The User shall not disseminate, transmit, or make available to third parties any information, element, or content that constitutes unlawful or unfair advertising.
- The User shall not transmit unsolicited or unauthorised advertising, promotional material, spam, chain letters, pyramid schemes, or any other form of solicitation, except within areas (such as designated commercial spaces) that are expressly intended for such purposes.
- The User shall not introduce or disseminate false, misleading, ambiguous, or inaccurate information or content in a manner that may mislead or deceive recipients.
- The User shall not impersonate other users of the Service, nor share account access data or passwords with third parties in order to carry out actions or negotiations on their behalf.
- The User shall not disseminate, transmit, or make available to third parties any information, element, or content without the authorisation of the holders of any applicable intellectual or industrial property rights.
- The User shall not disseminate, transmit, or make available to third parties any information, element, or content that results in a breach of laws governing the confidentiality of communications or the protection of personal data.
- The User shall not disseminate, transmit, or make available photographs or any representation or image of minors.
- The User shall not create or publish reviews or evaluations relating to transactions that have not actually taken place.
- The User shall not systematically extract or reuse, in whole or in part, the content of the Platform without the prior consent of Carp Tackle. In particular, the User shall not use data extraction tools, robots, scraping systems, or similar technologies (whether on a single occasion, repeatedly, or on a large scale).
- The User shall not disassemble, decompile, reverse engineer, or otherwise attempt to derive the source code of any part of the Platform.
- The User shall not use external software tools (including bots or automated systems), unless such use is expressly authorised or permitted by Carp Tackle.
4. REGISTRATION USER ACCOUNT
- Access to certain features of the Platform requires the User to create an account.
- The User is informed that accounts on carptackle.eu are personal, unique, and non-transferable.
- The User warrants that all information provided during registration is accurate, complete, and kept up to date.
- The User is responsible for applying appropriate confidentiality and security measures in relation to their access credentials for the Platform.
- The User must be of legal age and have sufficient legal capacity to use the Service.
- The Platform does not request or store sensitive personal data of Users, except for data that are necessary and functional for registration and for the use of the Service.
- The Platform does not store or use Users’ data for advertising purposes. The data requested and collected are functional and strictly necessary for the use of the services provided through the Platform.
- As a registered User, the User is at all times responsible for the safekeeping of their password and assumes responsibility for any damage that may arise from its improper use, as well as from its transfer, disclosure, or loss.
The User must immediately inform Carp Tackle if there is any reason to believe that their password has been used in an unauthorised manner or may be used without authorisation.
5. RULES OF USE AND COMMUNITY STANDARDS FOR USER CONDUCT AND RATINGS
- The User undertakes to use the Marketplace in compliance with applicable laws, and to act fairly towards other members, in accordance with the Guidelines and Code of Conduct set out in the Community’s Charter of Values and User Conduct.
- The platform encourages, promotes, and fosters proper conduct, fairness, and lawfulness through reputational mechanisms such as feedback and ratings.
- No direct, real-time moderation is carried out by CarpTackle.com: the Community is self-regulated through feedback, rating systems, and questions relating to listings/products.
- In the event that abuses and/or conduct inconsistent with the Community’s Code of Conduct and values are reported and/or ascertained, the Platform reserves the right to suspend the account and any services associated with the User’s profile involved in the violation, resulting in removal from the Community.

The User may publish reviews relating to transactions carried out on the Platform, describing their experience, whether acting as a Seller or as a Buyer. When publishing reviews, the User shall take into account the following:
a) Ratings must be objective, truthful, and related to the Product purchased or to the User with whom the transaction was carried out.
b) It is not permitted to publish defamatory, insulting, obscene, offensive, violent, or otherwise inappropriate content.
c) It is not permitted to publish reviews containing personal, sensitive, or any other confidential or private information.
d) It is not permitted to publish reviews for promotional or advertising purposes.
6. PAYMENTS AND FUNDS MANAGEMENT
Carp Tackle does not provide electronic payment services and does not carry out, either directly or indirectly, any form of financial intermediation activity. The rules governing payment management and transactions are established by the payment service provider, which operates as an independent third party external to the Platform.
In order to use the buying and selling services available on the Platform, Users may enter into an agreement with Stripe Payments Europe, Ltd. (or with another payment service provider, where available). Stripe, or any other available provider, manages payment services in accordance with its own policies, procedures, and applicable regulations.
To use the services offered through carptackleworld.com, Users are required to register with Stripe (or another available payment service provider) and to read and accept the applicable terms and conditions, privacy policy, and any other relevant legal documentation, all of which are made available directly on the provider’s website.
Accordingly, the User acknowledges and agrees that:
- All payments between Users are processed exclusively through external Payment Providers (such as Stripe or other available providers).
- At the time of the transaction, the amount paid by the Buyer is temporarily held by the Payment Provider for a limited and functional period, until shipment tracking information is entered by the Seller.
- Once shipment tracking has been entered, the Buyer has 48 hours to verify the shipment and, where necessary, report any discrepancies by using the “Report Abuse” function available in the restricted area of the Platform.
- If no report is submitted by the User within the 48-hour period, the system will automatically release the funds to the Seller.
- Where the Buyer fails to report any discrepancies within the 48-hour period following the entry of shipment tracking by the Seller, the User assumes full responsibility and fully indemnifies Carp Tackle against any issues and/or discrepancies arising from the failure to report irregularities relating to the shipment tracking provided by the Seller.
Regular monitoring of Platform communications and of the email account provided at the time of registration forms part of the Users’ duties of diligence and good conduct. - Where a report of abuse is submitted by the User within the 48-hour period, the funds shall remain held until confirmation of delivery in relation to the relevant purchase.
If the shipment does not take place, the Buyer shall receive a full refund in accordance with the procedures of the Payment Provider. - Delivery confirmation issued by the carrier shall constitute sufficient proof of delivery. Subsequent disputes shall not suspend or reverse the release of funds.
- Carp Tackle plays no role in the transfer of funds beyond the technical procedures implemented by the Payment Provider and shall not be held liable for any delays or issues in transactions caused by Users, the Payment Provider, or shipping carriers, which operate as independent and autonomous entities.
- All communications relating to payments and disputes must take place through the Platform and in accordance with the procedures indicated for dispute resolution.
7. INSTALMENT PAYMENTS (BNPL – BUY NOW, PAY LATER)

The Platform allows Users, at the time of purchase, to access instalment-based or deferred payment options (Buy Now, Pay Later – “BNPL”), depending on the available Payment Provider and the payment method selected by the User during checkout.
Any availability of instalment payments, as well as the related economic, temporal, and contractual conditions (including, by way of example, the application of interest, fees, penalties, or limitations), is governed exclusively by the direct relationship between the User and the Payment Provider responsible for managing the transaction.
The Platform:
- does not act as a financial or credit intermediary;
- does not grant financing, nor does it determine or modify the terms and conditions of instalment payments;
- assumes no responsibility for the approval, refusal, or management of instalment payments by the Payment Provider.
The order amount, regardless of the payment method selected by the User, shall be deemed fully authorised and confirmed at the time the transaction is completed.
The instalment payment arrangement constitutes an independent contractual relationship between the User and the Payment Provider and does not affect the contractual relationships between the User, the Platform, and the Seller.
Any complaints, requests for clarification, claims, or disputes relating to instalment payments must be addressed exclusively to the Payment Provider, in accordance with the procedures and time limits established by the provider.
It is understood that the use of instalment payment options does not modify the conditions of sale, the order fulfilment timelines, or the protections afforded to Users under these Terms and Conditions
7.1. INSTALLMENT PAYMENTS: REFUND MANAGEMENT IN CASE OF NON-DELIVERY
If the User chooses, during the Checkout process, an interest-free installment payment option made available through the payment partners integrated into the Platform (such as Klarna or other available providers), the related payment plan shall be managed directly by the selected financial provider in accordance with its own contractual terms, policies, and applicable conditions.
The verification and security procedures adopted by the Platform may not prevent the initial charge of the first installment provided for under the selected payment plan. However, in the event of shipping anomalies, non-delivery of the purchased item, or justified disputes relating to the transaction, the payment provider may, in accordance with its internal procedures, provide for the cancellation of the installment plan and the refund of any amounts already charged to the User.
Any refund of installments already paid, including the first installment, shall be managed directly by the payment provider in accordance with the terms and conditions applicable to the installment payment service used.
The User acknowledges that the installment payment arrangement constitutes a credit agreement entered into directly with the selected payment provider and that Carp Tackle does not act, either directly or indirectly, as a financial intermediary, contractual party, or entity responsible for managing the related credit relationship.
Users are therefore encouraged to carefully review the financial conditions, refund policies, and terms of service published by the payment provider at the time the installment payment option is activated.
8. PUBLICATION AND MANAGEMENT OF LISTINGS
- The Seller is solely responsible for the information contained in the listing, which must be accurate, complete, truthful, and sufficiently detailed.
- Listings must relate exclusively to used products and equipment for carp fishing.
- Images and descriptions must be authentic and must accurately reflect the actual condition and real state of the equipment offered for sale.
- Carp Tackle reserves the right to remove listings that violate these Terms and Conditions or applicable laws.
9. LISTING VISIBILITY AND VALUE-ADDED SERVICES
- Users may purchase paid services designed to increase the visibility of their listings (such as listing highlighting or featured placement) and to potentially accelerate the sales process.
- Prices and applicable conditions for such services shall be made available in the relevant dedicated section of the Marketplace.
10. COMMUNICATION AND DISPUTE MANAGEMENT
Carp Tackle provides an internal messaging and communication interface that remains active for 30 days from the date the shipment tracking code is uploaded. This period defines the technical communication and resolution process made available through the Platform.
Users are encouraged to independently resolve any disputes or disagreements by using the communication and support tools provided by the Platform and in accordance with the procedure described below.
10.1 Dispute Management
In the event that a report is initiated relating to:
- non-compliant goods;
- an item significantly different from the listing description;
- undeclared defects;
- shipping anomalies;
- conduct considered contrary to the Platform rules;
CarpTackle provides a technical dispute management procedure exclusively aimed at documentary verification and the management of the flow of funds connected to the transaction.
Please note that the Platform does not perform, and cannot perform, arbitration activities, legal mediation services, or commercial certification of goods exchanged between private users.
10.2 Dispute Procedure and Buyer Obligations
Any user wishing to initiate a dispute is required to:
- first contact the other party through the Platform’s internal messaging system (the feature will remain active for 30 days from the completion of the transaction);
- clearly and accurately describe the issue encountered;
- provide adequate supporting documentation, including:
- photographs;
- videos (users are encouraged to record a short video during the unboxing process upon delivery);
- screenshots;
- shipping-related documentation;
- any additional elements useful for verification purposes.
Reports must be submitted within 24 hours from the receipt of the item and/or the courier delivery notification:
- through the tools made available by the Platform;
- or by email to:
report.abuse@carptackle.eu
Reports lacking adequate documentation, incomplete reports, or reports that are manifestly generic may not be considered valid for the purposes of dispute management and initiation of the related procedure.
10.3 Dispute Procedure and Seller Obligations
The seller is required to:
- respond to communications received through the Platform messaging system within 3 calendar days. After this period, the system may automatically proceed with the refund of the amount paid by the buyer;
- cooperate during the dispute verification process;
- provide any additional documentation requested in response;
- maintain conduct consistent with the principles of good faith and fairness.
Failure by the seller to respond within the specified timeframe may be taken into consideration by the Platform within the scope of the technical management of the flow of funds.
10.4 Management of Funds During the Dispute
In the event of a dispute:
- the funds connected to the transaction may remain temporarily suspended;
- the Platform may temporarily restrict the expected automatic release of funds;
- any transfer of funds in favor of the seller may be delayed until documentary verification procedures have been completed;
- the Platform may proceed with the transfer and/or refund in the event of failure to comply with the applicable procedural requirements or deadlines.
The suspension of funds does not constitute automatic recognition of the validity of the dispute.
10.5 Possible Outcomes of the Dispute: Release of Funds to the Seller
Following documentary verification and evaluation of the available information, the Platform may proceed with the release of funds in favor of the seller in the event of:
- insufficient documentation;
- disputes not supported by adequate evidence;
- lack of cooperation by the buyer;
- agreement reached between the parties;
- violation of the Platform’s rules of conduct;
- failure to comply with the required procedure or applicable deadlines.
10.6 Possible Outcomes of the Dispute: Refund to the Buyer
Following documentary verification and evaluation of the available information, the Platform may proceed with a full refund to the buyer in the event of:
- failure to ship the item;
- invalid tracking information;
- documentation considered coherent and adequate;
- failure by the seller to respond within the required timeframe;
- agreement reached between the parties.
10.7 Return of the Item
Where applicable and considered necessary for the management of the dispute, the buyer may be required to return the item. Therefore:
- the buyer must follow the instructions received and/or any agreements reached with the seller;
- the return shipment must be made using a traceable shipping method;
- failure to return the item may affect the management of the refund;
- any shipping costs related to the return must be agreed upon between the parties.
10.8 Role of the PlatformCarpTackle does not guarantee, and cannot guarantee:
- the outcome of the dispute;
- the commercial conformity of the goods;
- the solvency of the parties;
- the absolute truthfulness of the statements made by users.
The Platform may limit itself to evaluating:
- the documentation provided;
- the communication history;
- tracking information;
- the consistency of the submitted elements;
- compliance with the applicable procedures,
exclusively for the purposes of the technical management of the flow of funds and the application of the Platform’s internal procedures.
CarpTackle does not assume the role of a party in transactions between private users and does not perform, and cannot perform, arbitration or legal mediation activities. However, it may technically facilitate communication and assist the resolution process between the parties.
11.LIABILITY
- In accordance with applicable laws and regulations, including Council Directive (EU) 2021/514 (“DAC7”), the Platform may be required to collect, verify, and report to the competent tax authorities certain information relating to Users who carry out relevant activities through the Marketplace.
Where a User meets the thresholds established under DAC7 (including, but not limited to, a number of transactions exceeding 30 and/or total consideration exceeding EUR 2,000 within a calendar year), the Platform is legally obliged to report such User’s data and transactional information to the competent tax authorities.
By using the Platform, the User acknowledges and agrees that:
– the Platform may request additional information and documentation necessary to comply with DAC7 obligations;
– the Platform may verify the information provided by the User;
– the Platform may transmit such information to the competent tax authorities, where required by law.The User remains solely responsible for complying with any applicable tax and reporting obligations arising from their activities carried out through the Platform.
ll information that Users share, upload, or transmit through the Platform, as well as any products they make available, sell, or transfer to other Users, remain under their sole and full responsibility.
Users are also required to comply with all legal and tax obligations arising from transactions carried out through the Platform.By accepting these Terms and Conditions, Users acknowledge and confirm that they are fully responsible for any product or listing published on the Platform, including:- the information provided through descriptions, images, or statements addressed to buyers or other Users, as well as the accuracy and completeness of all details supplied;
- the assumption of exclusive responsibility for transactions carried out with other Users and for any disputes that may arise therefrom;
- the obligation to indemnify and hold harmless Carp Tackle from and against any claims, fines, penalties, or sanctions that Carp Tackle may be required to bear as a result of the User’s breach of any legal obligations and/or of the rules governing use of the Service set out in these Terms and Conditions.
Carp Tackle further reserves the right to claim compensation for any damages that may be incurred.
Users are responsible for the accuracy of the information provided and for the proper fulfilment of their contractual obligations, in accordance with principles of lawfulness, fairness, and good faith, and in compliance with applicable laws and regulations.
Carp Tackle does not guarantee and cannot guarantee the quality, safety, or conformity of the products or equipment published on the Platform, as its role is strictly limited to that of a technical intermediary.
Accordingly, Users assume full and complete responsibility for the content they publish and for the buying and selling processes they personally conduct through the Platform.The Platform merely provides a space for interaction between Users and, under no circumstances, sells or purchases goods or provides the services advertised on the Platform.
Carp Tackle shall not be held liable for any damages arising from the use of the Marketplace.
The Platform operates essentially as a listing publication service that connects advertisers with interested parties, enabling, where possible, transactions relating to the goods and equipment published on carptackle.eu.11.1 Limitation of Liability (Non-Exhaustive List)
By way of example and without limitation, Carp Tackle shall not be liable for damages of any kind arising from:
- the manner in which Users use the Service, including the condition, origin, inaccuracy, or falsity of data provided by Users or of Products offered through the Service;
- content, information, opinions, or statements of any User or third parties that are communicated or displayed through the Service (including the exchange of images via the messaging system);
- the use of Service materials by Users, whether authorised or unauthorised, including any infringement of intellectual and/or industrial property rights, confidential information, or the rights of the Service or third parties;
- acts of unfair competition or unlawful advertising;
- the loss of User data due to causes not attributable to the Service;
- access by minors to content included in the Service;
- unavailability, errors, access failures, or lack of continuity of the Service;
- malfunctions or incidents affecting communications, deletions, or incomplete transmissions, with potential or actual loss of business;
- malfunctioning of, or issues related to, the email address provided by the User.
11.2 User Responsibility
All information that Users publish, include, or transmit through the Platform, as well as any products they offer, sell, or transfer to other Users, shall remain under their exclusive responsibility.
Users are also responsible for complying with all legal and/or tax obligations arising from transactions carried out through the Platform.By accepting these Terms and Conditions, Users acknowledge and agree that they are fully responsible for any Product or Listing offered on the Platform, as well as for the information provided through descriptions, photographs, and statements made to buyers or other Users, and for the accuracy of all other details supplied.
Users are solely responsible for transactions carried out with other Users and for any disputes that may arise therefrom.
11.3 Indemnification
Accordingly, the User undertakes to indemnify and hold harmless Carp Tackle from and against any claims, fines, penalties, sanctions, or charges that Carp Tackle may be required to bear as a result of the User’s breach of any legal obligations and/or of the rules governing use of the Service set out in these Terms and Conditions.
Carp Tackle further reserves the right to seek compensation for any damages that may be incurred as a consequence of such breaches.
12.LINKED CONTENT AND SERVICES ACCESSIBLE THROUGH THE SERVICE
12.1 The Service may include technical linking mechanisms, directories, and search tools that allow Users to access other websites and internet portals (hereinafter, “Linked Sites”).
12.2 The User acknowledges and agrees that access to Linked Sites shall be at the User’s sole risk and responsibility and releases Carp Tackle from any liability for potential infringements of intellectual or industrial property rights of the owners of the Linked Sites.
Likewise, the User releases Carp Tackle from any liability relating to the technical availability of the Linked Sites, as well as to the quality, reliability, accuracy, and/or truthfulness of the services, information, elements, and/or content accessible through such Linked Sites.
12.3 In such cases, Carp Tackle shall be responsible for the content and services provided by Linked Sites only to the extent that it has actual knowledge of their unlawfulness and has failed to deactivate the relevant link with due diligence.
Where a User believes that a Linked Site contains unlawful or inappropriate content, the User may notify Carp Tackle; however, such notification shall not, in itself, entail any obligation to remove the corresponding link.
12.4 Under no circumstances shall the existence of Linked Sites imply the establishment of any agreement with the operators or owners thereof, nor any recommendation, promotion, or endorsement by Carp Tackle of the statements, content, or services provided by such Linked Sites.
Carp Tackle is not aware of the content or services of the Linked Sites and, therefore, shall not be held liable, whether directly or indirectly, for any damages arising from the unlawfulness, quality, obsolescence, unavailability, errors, or lack of usefulness of the content and/or services of the Linked Sites, or for any other damage not directly attributable to Carp Tackle.
13.FORCE MAJEURE
Carp Tackle shall not be held liable for any delays, malfunctions, service interruptions, or failures to perform its obligations resulting from force majeure events or from circumstances beyond its reasonable control.
“Force majeure” shall mean any unforeseeable, unavoidable, or otherwise uncontrollable event beyond the reasonable control of Carp Tackle, the effects of which could not reasonably have been prevented, avoided, or limited through the adoption of ordinary technical, organizational, and security measures generally used within the industry.
Force majeure events include, by way of example and without limitation:
– Interruptions of telecommunications networks or internet services;
– power outages, systemic failures, or infrastructure malfunctions;
– cyberattacks, hacking activities, malware, viruses, unauthorized access, DDoS attacks, or other cybersecurity-related events;
– unavailability or malfunction of services provided by third parties, including payment providers, cloud services, hosting providers, APIs, logistics services, or external infrastructures;
– natural disasters, public health emergencies, fires, floods, wars, terrorist acts, civil unrest, governmental actions, or any other extraordinary event not attributable to Carp Tackle.
Carp Tackle adopts technical and organizational measures reasonably appropriate to protect the Platform, data, and transactions. However, the User acknowledges that no computer system, digital infrastructure, or security protocol can guarantee absolute security or be entirely immune from vulnerabilities, cyberattacks, fraudulent access, or harmful actions carried out by third parties.
To the maximum extent permitted under applicable law, Carp Tackle shall therefore not be held liable for any damages, losses, delays, alterations, unauthorized access, temporary unavailability of the Service, or other consequences arising from external events, cyberattacks, or force majeure circumstances not directly attributable to wilful misconduct or gross negligence on the part of the Platform.
14.INTELLECTUAL PROPERTY
- All content available on the Marketplace, including trademarks, logos, software, and layout elements, is the property of Carp Tackle or is used under licence.
- Any unauthorised use of such content is strictly prohibited.
15. AMENDMENTS TO THE TERMS AND CONDITIONS
- Carp Tackle reserves the right to amend these Terms and Conditions at any time.
- Continued access to or use of the Service following any amendments shall constitute acceptance of the updated Terms and Conditions.
- If the User does not accept the amended Terms and Conditions, the User must discontinue use of the Service.
16. GOVERNING LAW AND JURISDICTION
- These Terms and Conditions shall be governed by and construed in accordance with Italian law.
- Any disputes arising from or in connection with these Terms and Conditions shall fall under the jurisdiction determined by applicable law.
